“It is prescribed for you, when death approaches any of you, if he leaves wealth, that he make a bequest to parents and next of kin, according to reasonable manners. (This is) a duty upon Al-Muttaqûn.” Al Qur’an, Surah Al Baqarah, 2:180

In the inevitable event of death, the passing on of estate assets is the biggest financial transaction that we will ever have to plan for, and for Muslims it has additional importance due to the specific nature of distribution as stipulated within the Qur’an.

Those without a Will have no legally recognised document for the administration and distribution of their assets, so valuable and hard-earned possessions may not be distributed as intended. This is legally known as dying ‘intestate’. Family and friends will have no control over proceedings, leaving the government to step in to delegate retention and distribution of possessions using ‘intestacy’ laws (the Intestates’ Estates Act 1952).
